    Terms of Service

    Please read these Terms of Service carefully. By using Campervana's platform, requesting a quote, or submitting a booking, you agree to be bound by this document.

    Campervana is a New Zealand campervan and motorhome rental brokerage. We do not own, operate, insure, maintain or control any vehicles. Instead, we take your trip requirements, source a suitable vehicle from our network of independent rental operators ("Partners"), and connect you with them. All rental agreements, vehicle handover, insurance, bond, damage, cancellation and refund terms are entered into and managed directly between you (the "Renter") and the Partner we source for you.

    These Terms of Service govern the use of the website at campervana.nz (the "Platform"), all its associated subdomains, our instant quoting tool, our brokerage service, and any bookings placed through us.

    By agreeing to these Terms, you represent that you are:

    At least 18 years old; and

    Capable of entering into a legally binding agreement.

    How Campervana Works (Brokerage Model)

    Campervana operates as a rental brokerage. We are not a rental company. When you submit a booking through our instant quoting tool, you are engaging Campervana to search our Partner network and secure a suitable campervan or motorhome that matches your dates, pickup and drop-off locations, guests and vehicle preferences.

    The booking flow is: (1) you submit your trip details and payment card; (2) your card is pre-authorised for the 15% Campervana service fee at the time of booking; (3) we have 72 hours to source a Partner and vehicle that matches your requirements at the quoted price; (4) once a Partner is confirmed for you, the 15% pre-authorisation is captured as the Campervana service fee and becomes non-refundable; (5) the remaining rental balance is paid by you directly to the Partner (typically at pickup) under the Partner's own rental agreement.

    By submitting a booking you authorise Campervana (via our payment processor) to pre-authorise your card for the 15% Campervana service fee. If we are unable to source a suitable Partner and vehicle within this price range within 72 hours, the pre-authorisation will be released in full and no Campervana service fee will be charged.

    The 15% Campervana service fee is strictly non-refundable once we have successfully matched you with a Partner and that Partner has accepted your booking. This is because our service (finding, negotiating and securing the vehicle for you) has been fully performed at that point. Any subsequent cancellation, no-show, change of mind, vehicle issue, insurance issue, refund dispute, damage dispute or bond dispute is a matter between you and the Partner under the Partner's own rental terms, and does not entitle you to a refund of the Campervana service fee (except where required by New Zealand consumer law).

    Once we have introduced you to a Partner, your rental contract is with that Partner, not with Campervana. The Partner is the operator of the vehicle, the insurer of record (or arranger of insurance), the holder of your bond, and the counterparty for all pickup, drop-off, extension, damage, refund and dispute matters. Campervana is not a party to that rental contract.

    Campervana is here to help. If something goes wrong before, during or after your trip, you can contact us at info@campervana.nz and we will do our best to assist by liaising with the Partner on your behalf. However, we have no legal obligation, authority or liability to resolve disputes, issue refunds on behalf of a Partner, arrange replacement vehicles, or intervene in any rental agreement. Any assistance we provide is offered as a goodwill service only.

    Platform Role and Relationship

    Campervana acts solely as an intermediary that facilitates connections between Renters and Partners. Campervana is not a party to any rental agreement, nor does it act as an agent, employee, or representative of any Partner.

    Campervana does not inspect, certify, warrant, or guarantee the safety, roadworthiness, cleanliness, legality, or suitability of any vehicle listed on the Platform. All vehicle descriptions, photos, pricing, availability, and condition are provided by Partners and are their sole responsibility.

    Listing a vehicle on the Platform does not constitute an endorsement, recommendation, or guarantee by Campervana of that vehicle or Partner. Users engage with each other at their own risk.

    No joint venture, partnership, employment, or agency relationship exists between Campervana and any user of the Platform.

    Payment Terms and Campervana Service Fee

    Campervana charges a 15% Campervana service fee on each booking, calculated on the total rental value. This fee is pre-authorised on your card at the time of booking and captured once we have successfully sourced a Partner and vehicle for your trip within the quoted price range within 72 hours. The fee covers our brokerage service, including sourcing, quoting, booking facilitation, messaging tools and customer support.

    The remaining 85% balance of the total rental cost is paid by the Renter directly to the Partner (typically at vehicle pickup) under the Partner's own rental agreement and payment terms. This payment is a transaction solely between the Renter and the Partner.

    Campervana is not responsible for any disputes, shortfalls, refunds, damage charges, bond deductions, additional fees or payment issues relating to the balance payment made directly between Renters and Partners. This includes, but is not limited to, disagreements over pricing, payment methods, refunds, or additional charges applied by the Partner.

    The 15% Campervana service fee is fully refundable only if Campervana is unable to source a suitable Partner and vehicle for your requested trip within this price range within 72 hours. Once a Partner has been successfully sourced and confirmed, the Campervana service fee is non-refundable, regardless of any subsequent cancellation, change of plans, no-show, or dispute with the Partner, except where a refund is required by New Zealand consumer law.

    Travel Fees, Inter-Island Travel and One-Way Rentals

    A separate travel fee may apply to any booking that involves travel between New Zealand's North Island and South Island, or where the pick-up and drop-off locations are different cities.

    These journeys are treated as a custom quote because the final cost depends on the specific vehicle, route, ferry schedules, relocation logistics and the rental partner's own terms.

    The level of service you receive from Campervana remains the same, but the total rental amount confirmed by the partner may include an additional cost above the original instant quote.

    If the final confirmed price, including any applicable travel fee, is not acceptable to you, you may decline the proposed vehicle before the pre-authorisation is captured. In that case the pre-authorisation will be released and your card will not be charged.

    Limitation of Liability

    To the maximum extent permitted by law, Campervana shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Platform, any vehicle, or any interaction between Renters and Partners.

    Without limiting the above, Campervana accepts no liability whatsoever for:

    The condition, safety, roadworthiness, or mechanical fitness of any vehicle listed on the Platform.

    Any accident, injury, death, property damage, or loss of any kind arising from the use of a vehicle.

    Any act, omission, negligence, misconduct, or breach of contract by any Partner.

    Any act, omission, negligence, misconduct, or breach of contract by any Renter.

    The adequacy, validity, or existence of any insurance policy held by any Renter or Partner.

    Vehicle availability, cancellations, or no-shows by Partners.

    Loss of enjoyment, loss of opportunity, travel delays, or any consequential losses of any nature.

    Any financial disputes between Renters and Partners, including bond disputes, damage claims, or repair costs.

    In any event, Campervana's total cumulative liability to any user shall not exceed the amount of the platform fee paid by that user for the specific booking in question.

    Indemnification

    You agree to indemnify, defend, and hold harmless Campervana, its directors, officers, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including legal fees on a solicitor-and-own-client basis) arising out of or in connection with: your use of the Platform; your breach of these Terms; any rental transaction you enter into; any vehicle you list, rent, or use through the Platform; any dispute between you and another user; or any violation of applicable law.

    Partner Obligations

    Partners are solely responsible for the vehicles they list, including ensuring each vehicle is safe, roadworthy, legally registered, and compliant with all applicable New Zealand laws and regulations (including WoF and registration requirements).

    Partners must maintain adequate insurance coverage for their vehicles and are solely responsible for managing all insurance matters, claims, and disputes.

    Partners must ensure all listing information (descriptions, photos, pricing, availability, and vehicle specifications) is accurate and not misleading.

    Partners are responsible for establishing their own rental agreements directly with Renters, covering bonds, damage policies, cancellation terms, and any other conditions of rental.

    Renter Obligations

    Renters are responsible for conducting their own due diligence before entering into any rental agreement with a Partner. This includes inspecting the vehicle, verifying insurance coverage, and reviewing the Partner's rental terms.

    Renters must hold a valid driver's licence recognised in New Zealand and meet any minimum age or other requirements set by the Partner.

    Renters are responsible for arranging their own insurance or confirming coverage with the Partner before taking possession of any vehicle.

    Renters must treat all rented vehicles with reasonable care, comply with New Zealand road laws, and return vehicles in the condition agreed with the Partner.

    Disputes Between Users

    Any dispute arising between a Renter and a Partner (including disputes relating to vehicle condition, damage, bonds, refunds, cancellations, or any other matter) is strictly between those parties. Campervana is not a mediator, arbitrator, or party to any such dispute and has no obligation to intervene or resolve it.

    Users are encouraged to resolve disputes directly with each other. If a resolution cannot be reached, users should seek independent legal advice or use the Disputes Tribunal of New Zealand.

    No Warranties

    The Platform is provided on an "as is" and "as available" basis. Campervana makes no representations or warranties of any kind, express or implied, regarding the Platform, its content, or the services offered through it. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

    Campervana does not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

    Insurance Disclaimer

    Campervana does not provide, arrange, endorse, or verify any insurance coverage. Any references to insurance on the Platform are for informational purposes only. It is the sole responsibility of each Renter and Partner to obtain and maintain appropriate insurance coverage. Campervana accepts no liability for any losses arising from inadequate or absent insurance.

    Privacy and Data

    Personal information collected through the Platform is handled in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.

    Campervana may share limited user information between Renters and Partners solely for the purpose of facilitating bookings. We do not sell personal data to third parties.

    Governing Law

    These Terms are governed by the laws of New Zealand. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

    Account Termination

    Campervana reserves the right to suspend or terminate any user's access to the Platform at any time, for any reason, without prior notice or liability. This includes, but is not limited to, breaches of these Terms, fraudulent activity, or conduct deemed harmful to the Platform or its users.

    Severability

    If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

    Entire Agreement

    These Terms, together with the Privacy Policy, constitute the entire agreement between you and Campervana regarding the use of the Platform, and supersede all prior agreements, understandings, and representations.

    Changes to These Terms

    Campervana may update these Terms at any time by posting the revised version on the Platform. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
