Campervana Rental Agreement Terms and Conditions

Please read this Terms and Conditions document carefully. By using Campervana’s services, you agree to be bound by this document.
These terms (“Agreement”) set out the conditions under which you (“Hirer”) agree to rent a vehicle (“Vehicle”) from Campervana. By proceeding, you accept all terms outlined here.
This Terms and Conditions document governs the use and provision of services offered by campervana.nz (the “Site”) and all its associated subdomains connected to it.
By agreeing to the Terms, you represent that you are:
– At least 18 years old; and
– capable of entering into a legally binding agreement with Campervana.

Payment Terms
- Full payment is required upfront via New Zealand bank transfer or cash.
- Bank transfers must clear before the campervan is released.
- No refunds will be provided for cancellations under any circumstances.
Insurance
- Renters must arrange their own insurance through Trade Me Insurance.
- The “Pay Monthly” insurance option must be selected.
- Proof of an active insurance policy must be provided before the campervan is released.
- Renters are responsible for maintaining the insurance policy throughout the rental period.
Campervan Use
- The campervan must not be driven off-road, on unsealed or restricted roads, or used for any illegal activities.
- The campervan must remain within New Zealand unless prior written approval is obtained.
- Renters are responsible for the actions of all drivers and passengers.
Driver Requirements
- All drivers must hold a valid and full driver’s licence recognised in New Zealand.
- Drivers must be at least 21 years old.
- A copy of each driver’s licence must be provided before the rental period.
Damage and Liability
- Renters are liable for any damage, theft, or loss to the campervan during the rental period.
- Any claims must be processed through the renter’s insurance policy.
- If the campervan is returned with damage, the renter will be responsible for repair costs not covered by their insurance.
Vehicle Condition and Cleanliness
- The campervan will be provided in a clean and roadworthy condition.
- Renters must return the campervan in the same condition, including cleanliness.
- A cleaning fee will apply if the campervan is returned unclean or with excessive waste.
Breakdowns and Repairs
- In the event of a breakdown, renters must immediately contact Nelson Campervan Rentals.
- Repairs must not be undertaken without prior approval.
- Nelson Campervan Rentals is not liable for any consequential loss or expenses resulting from a breakdown.
Cancellations and Refunds
- No refunds will be provided for cancellations, regardless of timing or circumstances.
Unmarked Vehicles
- All campervans are unmarked to ensure discretion and privacy. This design allows renters to blend in wherever they travel without drawing attention.
Privacy and Data
- Personal information collected during the booking process is used solely for rental purposes.
- Data will not be shared with third parties unless legally required.
Termination of Agreement
- Nelson Campervan Rentals reserves the right to terminate the agreement if renters breach any terms and conditions.
- In such cases, the campervan must be returned immediately, and no refunds will be provided.
Additional Fees
- Late returns will incur an additional daily rental charge.
- Renters are responsible for any fines, tolls, or penalties incurred during the rental period.
Indemnity
- Renters agree to indemnify and hold Nelson Campervan Rentals harmless from any claims, damages, or liabilities arising from the use of the campervan during the rental period.
Consumer Rights
- Your rights under this agreement are in addition to those provided under applicable consumer protection laws, including New Zealand Consumer Law. These rights are not excluded or modified by this agreement.
Definitions
- Agreement: Any confirmation and/or the rental agreement.
- Bond: The amount paid by the renter to cover any liability under this agreement.
- Collection Point: The location specified for campervan pick-up.
- Confirmation: Booking confirmation outlining details such as vehicle type, fees, dates, and locations.
- Excess Reduction Cover: Optional insurance to reduce liability.
- Fee: Daily rental costs and additional agreed-upon fees.
- Rental Agreement: The signed agreement that includes these terms.
- Return Location: The location where the campervan must be returned.
- Vehicle: The rental campervan, tyres, tools, and all related equipment.
Rental Duration
- Term of Hire: The rental period begins at the specified pick-up date and ends at the specified return date.
- Minimum Rental Periods: Confirmed at booking and cannot be modified without agreement.
Rates, Amendments, and Cancellation Policy
- Rates are confirmed at booking and will not change unless amended by the renter’s request.
- Booking amendments (e.g., campervan type, dates) may affect rates and are subject to availability.
- No refunds are provided for voluntary downgrades or cancellations.
Persons Who May Drive the Vehicle
- Only individuals specified in the rental agreement may drive the campervan.
- Drivers must meet all licence requirements, including accredited translations for non-English licences.
Hirer’s Obligations
- Return the campervan clean, with a full fuel tank and gas bottle if applicable.
- Ensure proper handling, parking, and security of the campervan.
- Maintain water, oil, and tyre pressure levels.
- Report any damage or mechanical issues immediately.
Payment by Hirer
- All fees, bonds, and additional costs must be paid in full before collection.
- Renters are responsible for fuel costs unless a pre-purchase option is selected.
- Accepted payment methods include Visa, Mastercard, Union Pay, and American Express, with surcharges applicable.
Hirer’s Liability
- Renters are liable for damage to the campervan or third-party property during the hire.
- Consequential costs, such as towing or loss of revenue, are also the renter’s responsibility.
Additional Costs
- Extra fees may apply for late returns, additional drivers, young driver surcharges, or premium locations.
Mechanical Repairs, Accidents, and Equipment Failure
- Renters must report any mechanical issues or accidents immediately.
- Renters must not admit fault at the scene of an accident and must cooperate with damage claims processes.
Return of the Vehicle
- Renters must return the campervan on time, clean, and with a full fuel tank.
- Additional charges may apply for late returns, unclean vehicles, or missing fuel.
Breach of Contract
- Campervan rentals may terminate the hire if renters fail to comply with the agreement.
- In such cases, renters must return the campervan immediately, and no refunds will be provided.
